General Terms and Conditions of Transport AIRPORTBUS.eu
The present General Terms and Conditions of Transport apply to all transportation services provided by AIRPORTBUS.eu on behalf of the client.
The conditions mentionned in the “Frequently Asked Questions” on the website www.AIRTPORTBUS.eu and the General Conditions of use of the website (the disclaimer) are an integral part of the General Terms and Conditions.
1. Transport contract
ADS-TUYTTENS bvba operates regular services under the AIRTPORTBUS.eu® brand. Generally, this involves vehicles displaying the AIRTPORTBUS.eu livery. Nevertheless, some rides/journeys may be handled by other vehicles. Only passengers in possession of a AIRTPORTBUS.eu transport ticket have a contractual relationship with AIRTPORTBUS.eu.
1.1. The parties to the contract
The contract is concluded between ADS-TUYTTENS bvba, hereafter referred to as "the carrier" or "AIRPORTBUS.eu" and the person having purchased a transport service via the Internet, through the iPone application of AIRPORTBUS.eu, from a AIRPORTBUS.eu approved travel agency, from tha AIRPORTBUS.eu helpdesk or from a AIRPORTBUS.eu approved reseller, hereafter referred to as the "client".
1.2. Purpose of the contract
AIRPORTBUS.eu agrees to provide transportation for the client by coach from the place of departure to the destination selected by the client. The client agrees to pay the agreed price in accordance with the special terms and conditions of the contract.
The contract only covers transportation from the place of departure to the stated point of arrival, with no other services. Any prior or subsequent transport services which may possibly be ordered by the client must be considered as constituting separate, distinct contracts both regarding their performance and their remuneration.
Belgian and international coaches are used. Consequently, no demand for transportation by only a AIRTPORTBUS.eu coach or one provided by a specific partner agency may be considered.
1.3. Minors
Children and minors aged under 16 who are not accompanied by the person possessing parental authority over them are not accepted on board the coach for cross-border journeys.
Minors aged between 16 and 18 who are not accompanied by the person possessing parental authority over them are only accepted on cross-border journeys if they are in possession of their identity card or passport and an authorisation from their parents to leave the country, duly certified by their local authority or the police station for their area of residence. We also request that you take care to abide by the applicable international regulations.
2. Schedules
2.1. Schedule changes
The company reserves the right to carry out any changes concerning schedules, made necessary for important reasons and particularly in order to allow for the implementation of decisions taken by the competent authorities.
Changes in schedules implemented in good faith by the carrier after the conclusion of the contract will not entitle the client to compensation if the departure and arrival times only differ slightly (i.e. a maximum of two hours) from the originally agreed times. In the event of a major change to the times, the client will be entitled to cancel the transport contract.
Before booking, the client is informed of the departure time and scheduled stopping places applicable at the time of reservation and mentioned on the ticket. It may be the case that changes in the departure times and scheduled stopping places become necessary after the ticket has been issued. Consequently, the client is requested to make enquiries concerning any possible modifications shortly before departure, via the www.AIRPORTBUS.eu website.
2.2. Departure time
A departure time is stated on the client's ticket. However, a late departure will in no way create any requirement for the carrier to pay compensation.
The client agrees to be present at the departure point at least 10 minutes before the departure time. Under no circumstances will the carrier be required to wait for passengers beyond the scheduled departure time.
2.3. Arrival time
The arrival time stated on the client’s ticket is provided for information purposes only.
It is calculated based on average traffic conditions. Events and incidents such as traffic jams, slow traffic, road works, road accidents, whether conditions or the behaviour of other passengers may cause delays for which the carrier is in no way liable and for which he will pay no compensation of any form to clients.
3. Booking terms
3.1. Effective booking
The booking only takes effect after the ticket has been paid for in full and the acknowledgement of reservation (the ticket) has been received.
3.2. Payment methods accepted bookings
Bookings are possible on the www.AIRPORTBUS.eu website, on the AIRPORTBUS.eu iPhone application, trough the AIRPORTBUS.eu helpdesk, from a AIRPORTBUS.eu approved travell agency or from a AIRPORTBUS.eu approved reseller. It is also possible to purchase tickets directly from the driver, although this is subject to the number of places available in the coach.
3.3. Price calculation
The client acknowledges that the price of the ticket varies according to the destination, the departure time, the number of days remaining before the departure date and the coach occupancy level. Consequently, the same prices will not necessarily apply for a subsequent journey or for any additional orders placed later.
3.4. Payment terms
The client is required to pay for his ticket at the time of reservation. In the case of payment via the Internet, payment is only considered as having been made when the carrier has been credited with the ticket price.
Passengers who do not use the services they have reserved are not entitled to a refund or to exchange tickets.
4. Tickets
4.1. Proof
The transport ticket formally confirms the contract concluded between the client and AIRPORTBUS.eu. The confirmation received by e-mail constitutes the ticket. The client agrees to present this e-mail confirmation when boarding the coach, either in the form of a printed copy or via the AIRPORTBUS.eu iPhone application. Because the ticket can be printed more than once, the client must not forward the electronic confirmation to anybody. If however two passengers or two groups of passengers apply for transport with the same ticket, only one passenger or group of passengers will be transported under the cover of this ticket.
In theory, the confirmation provides sufficient proof that the journey has been reserved. However, the carrier’s staff are entitled to require the client to present official proof of identity, in order to verify that the electronic reservation actually belongs to him. Only clients who have been able to provide proof of their identity may use these transport services. Any clients who are not in possession of an official and conclusive identity card may not consider the carrier liable or claim any refund of costs or compensation in the event that the latter refuses to provide the transport service in question.
If he is unable to present proof of his reservation, the client will be obliged to purchase a ticket from the driver, subject to the number of places remaining.
4.2. Loss
The client may not consider the carrier liable for the loss of or damage to his ticket. The client has the possibility to print out his ticket again from the www.AIRPORTBUS.eu website if the ticket has been purchased online.
4.3. Non-transferability
The ticket is issued on a strictly personal basis and may not be sold or transferred to a third party.
4.4. Partial use of the ticket
When the journey includes several stops, the client is free to leave the coach at any stop preceding the final destination stated on his ticket. However, the client will not be entitled to request a partial refund as result, or to use his ticket in any other coach to complete the journey.
4.5. Modifying a reservation
An AIRPORTBUS.eu ticket cannot be modified. However, the client has the possibility to cancel his reservation and to make a new reservation incorporating the desired modifications. It should be noted that the price of the ticket may vary according to the number of days before the travel date and the coach occupancy level. This modification can be made up to 48 hours before the coach departs.
4.6. Cancelling a reservation
The price for the cancelled ticket will be credited to the client's AIRPORTBUS.eu account and may be reused for future journeys. This credit will remain valid within a period of one year from the original purchase. Cash refund of cancelled tickets is not possible.
5. Luggage
5.1. General conditions
The transport of luggage is subject to the conditions and rates stated in the “Frequently Asked Questions” on the web site www.AIRPORTBUS.eu.
5.2. Right of inspection
For safety and security reasons, the client accepts that a luggage inspection can be carried out by the " AIRPORTBUS.eu " staff. In the event of a refusal, the carrier will be entitled to refuse the transportation of the luggage in question.
5.3. The nature of recipients
All luggage must be suitably packed in suitcases, bags or other appropriate recipients able to stand up to normal handling conditions. Fragile items must be specially packed according to their nature.
5.4. Identification labels
All luggage must be clearly identified by means of a label mentioning the passenger's name, his address and his telephone number and when available his e-mail address.
5.5. Right of refusal
The carrier is entitled to refuse any luggage which does not meet the above-mentioned conditions. If, as a result of this refusal, the client then decides not to make the trip, the carrier will not be considered liable vis-à-vis the client in any manner and the full ticket price will nevertheless be payable.
5.6. Lost or abandoned luggage
If the client leaves an item or luggage in the coach after its arrival at the destination, the carrier is entitled to refuse to bring back the luggage and to leave it at the place of destination if he considers that it poses a risk to safety or security or if the remaining space would be insufficient to store the other passengers' luggage.
The carrier will seek to contact the client to inform him that he has forgotten his luggage. Should the client have failed to include the necessary label on the outside of his luggage stating his personal information, the carrier will however not be required to seek the owner's identity by other means.
In the event of a claim from a client for an item or for luggage left in the coach, the carrier is entitled to demand any proof he considers necessary in order to demonstrate ownership of the item in question. When in doubt, he may even demand a corresponding deposit or any other form of surety from the person issuing the request.
5.7. Loss or damage
The carrier may not be considered liable in cases involving the theft of, or damage caused to hand luggage brought into the passenger cabin. The client agrees to keep watch over his own luggage.
Regarding luggage carried in the luggage compartment, the carrier may only be considered liable in situations in which luggage items are damaged due to fault or negligence on his part. However, the carrier's liability may under no circumstances exceed €150 per item of luggage carried.
When the client considers that the value of his luggage exceeds the above-mentioned limit, he must contact the carrier at least 14 days before the start of his journey to negotiate a higher cover level.
On the other hand, the carrier may not be considered liable for the loss or theft of luggage carried in the luggage compartment.
Under no circumstances may the carrier be considered liable for damage caused to luggage which does not strictly comply with the traditional interpretation of the term "luggage" (i.e. electronics equipment, televisions, household appliances or other devices, binoculars, etc).
5.8. Obligation to check and remove luggage
Before departure, the client agrees to check that his luggage has been placed in the luggage compartment. Upon arrival at the place of destination, the client agrees to remove all luggage belonging to him.
5.9. Animals
The conditions and rates for transport of animals are stated in the “Frequently Asked Questions” on the website www.AIRPORTBUS.eu. This conditions are an integral part of the contract.
6. Transport
The transport meets the European regulation on regular transport of persons by road.
6.1. Departure point
The departure point is stated on the ticket. The client will board the coach at the departure point. The carrier reserves the right to resell free space if the client fails to present himself at the departure point.
If the client presents himself at a stopping place further from the end destination than the departure point he initially reserved, the carrier is entitled to refuse him. If he accepts, (subject to available places) AIRPORTBUS.eu reserves the right to apply a surcharge.
6.2. Place of arrival
The place of arrival is stated on the ticket.
If however, for reasons outside the carrier's control (such as public works/construction work, accidents, demonstrations, weather conditions, etc). the place of arrival is not accessible by coach, the carrier is entitled to select another place of arrival near to that initially scheduled. He will not be liable for payment of any compensation or the reimbursement of costs, etc.
6.3. Seats
- No seats are allocated. The client is not entitled to demand a particular seat on the coach. He may only request a change of seat by arranging this amicably with the passenger already seated there.
- The client is not allowed to occupy a seat by placing luggage or other personal items there, or by stretching out across several seats unless he has reserved and paid for these additional seats.
6.4. Lack of space
If the carrier is unable to propose a place for the client despite the fact that the client had made a reservation, the carrier is only required to offer the client either a refund of 2 times the ticket price, (with a minimum of €10), or a place on a later coach. The client is entitled to claim no other compensation.
7. Behaviour on board the coach
7.1. General terms
The passengers have to abide by de terms of the articles 33 to 37 of the Belgian Rules and Policy of Transport by tram, pre-metro, underground, busses and coaches (Royal Dectree of 15th September 1976 as amended until today) which is considered an integral part of the present contract.
7.2. Clothing
The carrier's staff are entitled to refuse access to the coach to any person who is not appropriately dressed.
7.3. Salubrity
Similarly, access to the coach may be denied to persons in a state of drunkenness or uncleanliness.
7.4. Noise pollution
Throughout the entire journey passengers are forbidden to listen to music using loudspeakers. Headsets may be used on condition that the volume is set sufficiently low that it does not disturb other passengers.
7.5. The consumption of foodstuffs
Passengers must not consume foodstuffs which may disturb other passengers (particularly due to their smell) or soil the coach.
7.6. General clause
The client-passenger's behaviour must be such that other passengers are not disturbed, that the journey is conducted in a peaceful atmosphere and that the fixtures and fittings of the coach are not damaged or soiled.
Smoking in the coach is strictly forbidden.
The client is required to abide by any bans or instructions issued by the carrier's staff.
Consequences of unacceptable behaviour: the carrier is entitled to cease the achievement of the service with no obligation to issue a refund.
The carrier may not be considered liable for the behaviour of other passengers in the coach.
8. Final clauses
8.1. The protection of personal data
Data submitted by the client to the carrier will be used as stated in article 5 of the Terms and Conditions for the Use of the Website of AIRPORTBUS.eu (dislaimer). It will be used by the carrier in order to perform the requested services and for customer relationship management purposes. The client agrees to receive a survey questionnaire concerning the product quality within a period of one to two months after his trip. Furthermore, the client grants the carrier the right to use his contact information in order to inform him of new products. However, the client also has a right of opposition and may therefore inform the carrier that he does not wish (or no longer wishes) to receive information concerning new products and services.
8.2. Identity documents
The passenger bears full liability and responsibility for all necessary documents (identity cards, passports, visas, authorisations to leave the country, etc.) required for police and Customs-related formalities in the country of departure, those countries through which the coach will be passing in addition to the destination country. Passengers should enquire about the formalities to be completed before purchasing their ticket. In all circumstances, the passenger must provide proof of his identity when boarding. This identity must be that of the person named on the ticket.
If a passenger is taken off the coach for a detailed customs inspection, the passenger must not leave any belonging on board the coach.
The carrier will bear no liability vis-a-vis any traveller who fails to abide by these requirements. Consequently, the carrier may under no circumstances be considered liable for any total or partial refund of the passenger’s ticket or for the payment of any compensation.
8.3. The carrier’s participation
If, during the performance of the transport contract, the carrier operates via third parties in order to propose services to the client, he should be considered as a simple agent and may only be considered liable for negligence or faults during the performance of his assignment.
8.4. Right of withdrawal
The consumer hereby states that he has no right of withdrawal according to the first article of the (Belgian) Royal Decree of 18th November 2002.
8.5. Applicable Law and Jurisdiction
The present General Terms and Conditions of Transport are subject to and shall be interpreted and construed in accordance with Belgian law. Except when the law expressly specifies the competent judge, all claims may only be brought before the competent judge for the domicile of AIRPORTBUS.eu.
If certain provisions of these General Terms and Conditions of Transport are held to be inapplicable, the remaining provisions shall be deemed to be unimpaired and the inapplicable provision(s) shall be replaced by an applicable provision, the purport of which shall be as close as possible to that of the provision held to be inapplicable.
his Agreement shall form an integral part of any other agreements you have entered into or shall enter into with AIRPORTBUS.eu, one of its related companies or companies in the group to which AIRPORTBUS.eu belongs.
In the case any unconformity appears between some provisions of the present English translation and the original General Terms and Conditions of Transport, only the provisions of the Dutch text twill be applicable.
AIRPORTBUS.eu shall be entitled to amend these General Terms and Conditions of Transport at any time, with immediate effect and without prior notice.
8.6. Complaints
Complaints will only be considered if these are submitted within a period of 14 days following the journey date.
